WAILUKU, Hawaii (AP) - A Maui man found guilty of murder in the death of his pregnant ex-girlfriend says he needs time to decide if he’ll testify about whether the killing warrants life in prison without possibility for parole.
A jury convicted Steven Capobianco of murder and arson Wednesday in the 2014 disappearance of Carly “Charli” Scott. The jury also has to decide if he caused her death in an “especially heinous, atrocious, or cruel manner.”
Capobianco is expected to let the judge know Friday whether he’ll testify in the phase of the trial to determine if he should get an enhanced sentence.
Capobianco says, “literally the rest of my life depends possibly on this decision.”
Defense attorney Jon Apo says his client is processing the guilty verdict.
