WILKES-BARRE, Pa. (AP) - The parents of a 21-month-old boy who died last year from bleeding in the brain are suing a Pennsylvania county and its Children and Youth agency, alleging that a lack of oversight caused his death.

Nichole Puscavage and Anthony Cook, both of Wilkes-Barre, filed a lawsuit against the Luzerne County and its agency on Monday.

The suit says Anthony Puscavage was declared dependent in September 2014 and placed under Children and Youth’s custody.

The boy was found unresponsive on Jan. 10, 2015 and died the next day. The suit says an autopsy revealed injuries the boy sustained were due to traumatic abuse.

It claims the agency didn’t follow its own requirements to fully assess and investigate caregivers and relatives in the home before placing the boy with Cook’s relative.
