GREEN BAY, Wis. (AP) - A judge has rejected a new trial for one of the five men still incarcerated for killing a Wisconsin paper mill co-worker in 1992.

Retired Judge James Bayorgeon on Wednesday denied Keith Kutska’s bid for a new trial.

Kutska’s attorneys argued that the theory that the victim, Tom Monfils, killed himself was not properly argued at the original trial.



But WLUK-TV (https://bit.ly/1RN01Tb ) reports Bayorgeon, who presided over the trial, concluded there were no grounds for a retrial.

Kutska was one of six men convicted of killing Monfils, whose body was found in a paper vat at the former James River paper mill in Green Bay. The conviction of one of the six, Michael Piaskowski, was overturned by a federal court and he was released.

An attorney for Kutska declined comment.
