PIERRE, S.D. (AP) - The South Dakota Supreme Court is considering an appeal on a ruling that determined the state was responsible for damages caused by a 2010 flood in the small community of Shindler.
Five families sued the state after their homes were destroyed by the flood. A lower court determined the state was at fault because it failed to create adequate drainage underneath Highway 11 in Shindler, and a jury awarded a combined $1 million in damages to the families.
Attorneys debated the decision Tuesday as the South Dakota Supreme Court heard the state’s appeal. KELO-TV (https://bit.ly/22YZQJA ) reports that the high court is expected to give a written decision about this case at a later date.
