WINCHESTER, Va. (AP) - Virginia State Police say a man who was shot by a sheriff’s deputy in Frederick County has been charged with attempted capital murder of a law enforcement officer.
A department spokeswoman said in a news release that a grand jury indicted 42-year-old Charles H. Cook Jr. on Thursday. In addition to four counts of attempt murder, Cook was also indicted on charges of use of a firearm in the commission of a felony and possession of a firearm by a violent convicted felon.
Authorities say deputies responded to a 911 call on Feb. 7 about an armed man threatening suicide. Police say Cook fired at the deputies but missed. A deputy returned fire, striking Cook.
Authorities say after Cook was released from the hospital, he was arrested a probation violation.
