TUCSON, Ariz. (AP) - An Arizona court has upheld a Tucson man’s conviction and life sentence in the 2012 shooting death of his former business partner.

The state Court of Appeals’ ruling Wednesday denies Bryan Peter Foshay’s appeal of his conviction for first-degree murder in the killing of 39-year-old Brian Blackwell.

Blackwell was found dead inside his apartment on January 30, 2012, after a relative went to check on him.



Pima County prosecutors said Foshay shot Blackwell in the head over a dispute involving a past partnership in a medical-marijuana growing endeavor.

The Court of Appeals rejected arguments in Foshay’s appeal over technology used to match bullet evidence, use of an expert’s written report, testimony about another expert’s findings and the trial judge’s refusal to allow testimony about the victim’s involvement with illegal drugs.
