DOVER, Del. (AP) - A man who was arrested in Delaware earlier this year on immigration and drug charges after having been deported five times to the Dominican Republic has agreed to enter a guilty plea in federal court.

A federal judge on Monday scheduled a May 31 change-of-plea hearing for Richard Diaz-Garcia, who is charged with illegal re-entry and heroin possession.

Court documents show Diaz-Garcia has been deported to the Dominican Republic five times and has two previous convictions for illegal re-entry.

The February arrest of Diaz-Garcia drew renewed interest recently amid media attention to legislation introduced in the General Assembly last year that that would have made Delaware a “sanctuary state.”

State Sen. Bryan Townsend of Newark, who is seeking the Democratic nomination for Congress, withdrew the legislation last week.
