MILLSBORO, Del. (AP) - Authorities say a driver was intoxicated when his van struck a 10-year-old boy who had run into a south Millsboro road to try to retrieve two baseballs.

Delaware State Police say the boy was in serious condition after being hit by 54-year-old driver John C. Swift on Saturday afternoon.

Police say the boy didn’t see the van, and Swift immediately stopped after the incident.

Swift was uninjured. He has been charged with driving under the influence and driving with a suspended or revoked license.

It wasn’t immediately clear if Swift has an attorney.
