MUSKOGEE, Okla. (AP) - A Shawnee man has received three life sentences for the shooting deaths of three people in 2004.

Federal prosecutors say 53-year-old David Magnan was sentenced Wednesday in U.S. District Court in Muskogee for the deaths of James Howard, Karen Wolf and Lucilla McGirt.

Prosecutors say Magnan first shot and wounded a man outside the home where the victims were staying, then went inside and shot the three as they lay in bed. McGirt identified Magnan as the gunman before she died.

Magnan pleaded guilty to state murder charges and was sentenced to death, but a federal appeals court ruled the state couldn’t convict him because the crimes occurred in Indian Country, where the federal government has jurisdiction.

He then pleaded not guilty before being convicted last October.
