YELLVILLE, Ark. (AP) - A 23-year-old man charged in connection to the death of a young girl in Marion County has pleaded not guilty.

Cody Allen of Mountain Home pleaded not guilty to capital murder Wednesday in the death of Alithia Boyd. Alithia was nearly 2 years old at the time of her death.

Officers responded after receiving a call about an unresponsive child at an apartment in Flippin on May 1. The child was taken to a hospital in Missouri, where she died several days later as a result of her injuries.

Allen faces life in prison without the possibility of parole or the death penalty, if convicted.

Prosecutor David Ethredge says that the investigation is ongoing, and that the state has not decided whether it will seek the death penalty.
