NORTHAMPTON, Mass. (AP) - A judge has declared a mistrial in the case of a New York man charged with raping a 5-year-old girl in Massachusetts in 2001 after the jury convicted the defendant, but one juror expressed doubt about the verdict.

The Daily Hampshire Gazette (https://bit.ly/1VdBycf ) reports that 47-year-old Guy Bush Jr., of Grand Island, wept when the jury announced the guilty verdict Thursday.

His attorney asked that jurors be polled individually. One female juror, when questioned, said “some people didn’t completely agree.” The judge immediately declared a mistrial.

Prosecutors allege Bush molested the girl multiple times while living in South Hadley. He knew the girl’s family but is not related.

Bush took the stand in his own defense to deny the charges.

Prosecutors plan to retry, and Bush remains jailed on $100,000 bail.
