CHARLESTON, W.Va. (AP) - A special court has certified Logan County’s election results and dismissed a petition filed by a county circuit judge, which sought to overturn votes so he could remain on the bench.
Media outlets report that after losing in his race by 59 votes to Joshua Butcher, Circuit Judge Douglas Witten claimed that irregularities in the polls in May should void the votes cast at several county precincts.
A three-member special court filed an order Monday with Gov. Earl Ray Tomblin’s office saying the evidence presented by Witten “did not rise to the level of demonstrating that their actions amounted to misconduct affecting the result of the election.”
Witten was appointed by Tomblin last year, when then-Circuit Judge Roger Perry retired. Butcher is Perry’s former law clerk.
Witten has 30 days to appeal.
