CLEARFIELD, Utah (AP) - Prosecutors say three Davis County police officers were justified in fatally shooting an armed man last month.

In letters obtained Saturday by the Standard-Examiner in Ogden (https://bit.ly/2cl9x08), Chief Deputy Davis County Attorney David Cole says investigators determined all three reasonably implemented the use of deadly force in the Aug. 3 shooting.

Clearfield police say they were pursuing 31-year-old Benjamin William Heaton, of Layton, after he fled from a stolen vehicle during a traffic stop.



They say a SWAT team was called when Heaton climbed onto the roof a detached garage.

Authorities say he fired off several shots and threatened to shoot an officer during the negotiation process.

Davis County Sheriff’s deputy Brooklyn Webb, Layton officer Eric Smith and Clinton officer Tyler Cunningham all returned fire, killing Heaton.
