PITTSFIELD, Mass. (AP) - A Pittsfield man has been charged with vehicular homicide in the death of a 74-year-old man who was run down while walking on a sidewalk.
The Berkshire Eagle reports (https://bit.ly/2p56lLr ) that 23-year-old Devyn Banister entered a not guilty plea Wednesday to the upgraded charges including motor vehicle homicide while under the influence of alcohol.
Prosecutors say Arthur Meyrick was walking near Clapp Park on Dec. 8, when Banister’s vehicle jumped a curb and struck him.
He survived the crash, but suffered multiple injuries and had his right foot amputated.
He died on Jan. 28.
Banister told police he was driving home when he nodded off and woke up when his cars airbags deployed.
He’s due back in court on Oct. 3.
