OLATHE, Kan. (AP) - A Kansas homeowners association has told a couple living with an ailing parent that they must stop parking a car in their driveway overnight because its policy requires that vehicles be kept in garages.

The Avignon Villa Homes Community Association’s property management company said in a letter that it has a responsibility to maintain “the integrity” of the Olathe neighborhood where Marsha Holland, her husband, Stuart Holland, and her parents, Ed and Mary Ann Majewski, live. Ed Majewski, 83, is battling cancer, The Kansas City Star reports.

The parking issue has pitted neighbor against neighbor in a homeowners association already embroiled in a lawsuit with another resident over a landscaping project it deemed “over the top.” Legal fees in that case are in the hundreds of thousands of dollars.

Stuart Holland, a deacon at Holy Trinity Catholic Church in Lenexa, said “there appears to be no sense of compassion, no sense of empathy.”

The Majewskis moved to Kansas City from Florida five years ago to live with the Hollands, who help monitor their care. The two couples settled into a four-bedroom home with a two-car garage.

The Hollands knew about the parking restriction before moving into the home. They were told by their real estate agent that they could get a variance for a third car and probably renew it every year. But problems arose this year, with the association’s property management company sending them the letter in July telling them they couldn’t get another variance. The Hollands have until Jan. 1 to comply with the parking directive.

“I’m not sure what we’re going to do,” Holland said. “We don’t want to be forced to tell my father-in-law that he can’t have his car anymore. And the stress of this stuff is really taking a toll on him.”
