LINCOLN, Neb. (AP) - A Nebraska county treasurer who faces criminal tax fraud charges has written the county a check for nearly $3,500 to cover the amount he received in now-questioned mileage expense reimbursements.

The state auditor’s office released a report last week that says Lancaster County Treasurer Andy Stebbing didn’t keep adequate documentation of his mileage expenses for over 2½ years, the Lincoln Journal Star reported . The report said mileage forms lacked reasons and dates for some of Stebbing’s trips and may have included incorrect mileage and reimbursement requests for trips taken on legal holidays.

Stebbing, 53, said he was never instructed to provide more specific information, but that he should’ve been more careful filling out the monthly mileage forms. He also said he only reported a portion of the miles he drove while on the job.

The Lancaster County Board has no objections to depositing Stebbing’s reimbursement check, said Todd Wiltgen, the board’s chairman.

The criminal matter against Stebbing remains, Wiltgen said. Law enforcement and prosecutors will decide whether or not to seek prosecution, he said.

Stebbing has been charged with falsifying bills of sale, filing fraudulent state income taxes and selling cars without a license. The charges stemmed from an investigation by the State Patrol and Nebraska Department of Revenue into Stebbing’s sales of vehicles and the income he generated.

Stebbing has served as county treasurer since 2011 and was re-elected in 2014. A Republican and retired Lancaster County deputy sheriff, Stebbing ran for Lincoln Mayor in 2015 but lost to Democratic incumbent Chris Beutler. He is currently running for re-election as county treasurer.
