FARGO, N.D. (AP) - A Cass County prosecutor says a motorist who fatally struck a bicyclist and dragged him under his car for a block will not face criminal charges because he was not to blame for the accident.
The decision letter that Tanya Martinez issued Thursday says the actions of 71-year-old Dr. Theodore William Kleinman were “appropriate and reasonable” and he had the right of way when the accident happened Sept. 19 in Fargo.
Martinez says 19-year-old Randy Bryson West was riding a bicycle with no lights and all the factory-issued reflectors removed and did not attempt to stop at the intersection where he was struck.
WDAZ-TV reports that Martinez based her decision on eyewitness statements, traffic camera footage and the police investigation. She says Kleinman was visibly distraught and cooperative after the accident.
