PORT ORCHARD, Wash. (AP) - Authorities say a 23-year-old man has been charged with murder in the death of an acquaintance he knew through his heroin dealer.

The Kitsap Sun reports (https://goo.gl/NkT4lo ) Andrew Phillip Gilbert pleaded not guilty to murder Wednesday. He’s being held on $1 million bail.

Gilbert was arrested Tuesday by Kitsap County Sheriff’s deputies at his house near Island Lake.

Investigators say Gilbert told them he shot Hector “Ricky” Apodaca, believing he was going to steal his BMW.

Court documents say Gilbert told investigators he was armed with a .25 caliber semi-automatic pistol on Saturday while he and Apodaca drove to visit someone who lived in the Seabeck area, and that Apodaca had become “hostile.”



Gilbert told investigators that he got scared and shot Apodaca twice when the car was stopped.

A motorist called 911 after seeing Apodaca’s body.
