PICKENS, S.C. (AP) - A company that wants to build a landfill in Pickens County that will store coal ash has recently won several legal battles.
The Greenville News reports (https://grnol.co/2hCrvQn ) that MRR Pickens will be allowed to take depositions from Pickens County Council members and the planning commission. It also had a lawsuit over its permit tossed out because a judge said the county didn’t meet a deadline.
The company has permission from state regulators to put coal ash in the landfill temporarily because it will be for beneficial reuse.
But Pickens County attorney Gary Poliakoff says it’s hard to see a legitimate beneficial reuse of coal ash.
The lawsuit started when the planning commission revoked a permit. The state Legislature then passed a law allowing the project to continue.
