SALT LAKE CITY (AP) - A Utah man accused in a drive-by shooting that hit a 9-year-old boy in the head has been charged with aggravated assault and weapons violations.

Court documents filed Friday say police tracked down 19-year-old Oscar Bermejo-Zaragoza of Layton after someone saw his car circling the block shortly before the shooting and wrote down the license plate number.

Prosecutors say a passenger got out and fired two shots in Kearns on Dec. 28.

Police have said they are still seeking at least one other suspect in the shooting. The boy remains hospitalized but has been moved out of intensive care.

Police say Bermejo-Zaragoza is a documented gang member. No attorney was immediately listed for him in court documents Friday.

Two other children also in the car weren’t injured.
