MONTPELIER, Vt. (AP) - A lawsuit challenging the housing policy in Burlington, Vermont, has survived a court challenge.

The American Civil Liberties Union sued the city in federal court last year on behalf of Joseph Montagno, who was evicted from his apartment after he made numerous phone calls to police for assistance from 2014 through 2016.

A judge on Thursday denied the city’s motion to dismiss the suit, saying Montagno can move forward with his claim that his First Amendment rights to complain to the police were violated and certain due process claims. Other claims were dismissed.

Montagno and other tenants called police, saying they were threatened by neighbors.

A lawyer for the city had said the lawsuit was without merit.
