SALT LAKE CITY (AP) - A Utah man has filed a lawsuit accusing an Ogden police officer of using excessive force while handcuffing him, causing three broken ribs and a punctured lung.

Forty-Three-year-old Guy Phillip Gailey claims he already was lying face down on the ground with his hands on his head when officer Rylee Marble put the full weight of his body behind his knee and “suddenly and violently” drove it into his back in early April.

Marble claims he dropped his knee the way he did because his momentum caused him to slip in the grass.

Gaily was riding a bike before the incident. He is accused of fleeing when an officer attempted to pull him over.

Gailey stopped fleeing a short time later and claims he got on the ground on his stomach to be arrested.
