RIVERTON, Wyo. (AP) - Fremont County Attorney Pat LeBrun will not seek the death penalty in the prosecution of Florin Brandon Wyatt, who is accused of killing another man with a claw hammer.

The Ranger reported (https://bit.ly/2s3Lz4u ) Tuesday the maximum sentence LeBrun might seek is life in prison without the possibility of parole.

The public defender’s office had asked LeBrun to make a decision by June 3 because of the effect a potential death penalty prosecution could have on trial preparations.

Wyatt is accused of killing Keith Stephenson of Riverton in March.

Court records say Wyatt had been living in Stephenson’s basement and that the killing occurred after Stephenson had tried to kick him out of the house.

Wyatt has pleaded not guilty to first-degree murder. His trial is set for Sept. 25.
