BROOMFIELD, Colo. (AP) - A Colorado judge has rejected a prosecutor’s request to seal the arrest affidavit of a man accused of killing a 4-year-old boy.
Emanuel Doll is charged with two counts of first-degree murder after the boy was found dead last month in a Broomfield home. The documents could reveal information about the killing, which authorities have not made public.
The Broomfield Enterprise reports (https://bit.ly/2qb7Ta1 ) District Judge Mark Warner ordered the arresting documents to be available for request on Wednesday.
The judge’s ruling came after an attorney for KUSA-TV and the Colorado Broadcasters Association argued the public has a right to monitor the proceedings.
Chief trial deputy Trevor Moritzky and defendant Doll’s attorneys both objected to the documents’ release. Mortizky says prosecutors worry it would distress the victim’s family and have a chilling effect on potential witnesses.
