SAN ANTONIO (AP) - A federal judge has denied dismissal of a lawsuit against two Texas deputies whose shooting of a man with his hands up was recorded in a video that went viral.

U.S. District Judge Robert Pitman ruled that the shooting of Gilbert Flores by Bexar (BAYR) County sheriff’s Deputies Greg Vasquez and Robert Sanchez in the August 2015 wasn’t reasonable. The San Antonio Express-News reports that even though Flores held a knife in one of his raised hands, Pitman ruled he posed no imminent threat to the deputies.

Pitman did dismiss Bexar County from the lawsuit brought by Flores’ family. A Bexar County grand jury had declined to indict the deputies.

The mother of the 41-year-old Flores had called police to report her son had beaten his wife and child.
