HUNTINGTON, W.Va. (AP) - A railroad company has denied that its hiring practices discriminate against women.

The Charleston Gazette-Mail reports that CSX Transportation in Huntington asked a federal judge in West Virginia on Sept. 29 to dismiss a complaint brought by the U.S. Equal Employment Opportunity Commission. The EEOC filed the lawsuit on Aug. 1 alleging that physical capability tests for applicants exclude women from being hired at the facility.

EEOC attorneys say CSX hired Amanda Hutchinson before terminating her based on performance on a physical capability test.

Commission lawyers said the physical exam requirement is a violation of Title VII of the Civil Rights Act of 1964. But the company says the tests are appropriate when selecting candidates for physically demanding jobs.

The next court hearing is set for Nov. 27.
