LEXINGTON, S.C. (AP) - Authorities have ruled a homeowner acted in self-defense when he shot and killed a neighbor in the front yard of a South Carolina home.

Lexington Police Chief Terrence Green said autopsy results show 31-year-old Derek Fogle had marijuana and several psychiatric prescription drugs in his system when he was killed July 23.

Green says Fogle ran up to Joseph Nicewonger, yelling before attacking him, throwing him to the ground and beating him in the head.

Green said in a news release Nicewonger had a gun and shot Fogle, then immediately called 911 and cooperated with police.

The chief says Nicewonger was allowed to protect himself with deadly force from being hurt or killed under state law.
