VERMILLION, S.D. (AP) - The South Dakota Supreme Court has ruled the owners of a recently constructed house in Sioux Falls must make the home conform to the historical standards of the neighborhood.
The court made the ruling Thursday in a dispute between Josh and Sarah Sapienza and their neighbors over the size of the home, which towers over other houses in a federal historic district.
The Argus Leader says the lawyer for the Sapienzas argued the couple got the necessary permits to build their home. They appealed a circuit court decision which said the home violates historic building standards. Neighbors sued the Sapienzas after they were told by the city they could no longer use their wood burning fireplace because it was too close to the new home.
