KANSAS CITY, Mo. (AP) - A Missouri attorney said she fractured her foot after she was pushed by an immigration agent early Tuesday while taking a 3-year-old boy to join his mother who was being deported to Honduras.

Immigration attorney Andrea Martinez said she had arranged with Immigration and Customs Enforcement to meet its Enforcement and Removals office in Kansas City around 3:15 a.m. so Noah could be reunited with his mother, Kenia Bautista, who is 6 months pregnant.

Activists and a documentary film crew captured the incident on video which appears to show someone being shoved and falling, but it was taken from a distance and some people standing near her block a clear view of what happened.

ICE said it takes any allegations against its personnel “very seriously” and is investigating.

The Kansas City Star reported that the boy and his mother were separated for a little more than a month while Bautista was being held in the Platte County jail. Noah had been looked after during the separation by his mother’s partner, Luis Alfredo Diaz, who is the boy’s father as well as the father of the unborn baby Bautista is carrying.

The boy’s father, Luis Alfredo Diaz, was carrying the boy to reunite with his mother, does not have legal status to be in the country and was detained, Martinez said.

Martinez said they had arranged to turn the boy over to his mother in the parking lot, but when they got to the facility Diaz was forced inside with the boy. An immigration a deportation agent pushed her out of the doorway so she and another lawyer could not enter the facility, causing her to fall. She contends the agent called Martinez into the facility a couple of minutes later, then detained her for about 40 minutes in a locked office and refused her medical treatment. She was later taken away in an ambulance.
