TOMS RIVER, N.J. (AP) - An appeals court has rejected a bid for a new trial for a man convicted of causing the death of a New Jersey police officer in a crash on Thanksgiving morning in 2010.
The Asbury Park Press reports that a three-judge Superior Court panel on Tuesday upheld the vehicular homicide conviction of 38-year-old Erick Uzcategui.
Ocean County prosecutors said Uzcategui’s sport utility vehicle crashed into the back of a vehicle driven by 32-year-old Ocean Gate Officer Jason Marles on the Garden State Parkway in Toms River. The nine-year veteran and father of two young children was heading home after working a drunken-driving detail.
The defendant challenged a number of elements in his conviction, including admission of blood-alcohol evidence that prosecutors said indicated he was driving under the influence.
