MARTINSBURG, W.Va. (AP) - A court has reversed a judgment awarded in favor of a West Virginia city sued by the estate of a man who was shot 22 times by officers in 2013.

The Journal of Martinsburg reports the U.S. Court of Appeals for the 4th District issued an opinion Monday saying “a reasonable jury could consider the totality of the facts and still find that the officers exercised excessive force” in their struggle with Wayne Jones. Jones was killed during a struggle with five Martinsburg police officers.

In 2013, a Berkeley County grand jury didn’t indict the officers, and Jones’ family filed a $200 million lawsuit that was dismissed.

Monday’s opinion acknowledged that Jones had a knife, but that officers’ accounts varied too much. The case has been remanded to district court.
