WHITE RIVER JUNCTION, Vt. (AP) - A Vermont judge has denied a new sentencing hearing for a man serving a 26- to 33-year sentence for the death of a state trooper who was a hit by a car during a 2003 chase on Interstate 91.
The Valley News reports Eric Daley, who is now 39, was denied a request for post-conviction relief on an involuntary manslaughter conviction from 2004. Daley had argued his court-appointed lawyers were ineffective.
On Friday Windsor Superior Court Judge Timothy Tomasi wrote that Daley’s now-deceased primary defense lawyer had developed a “rational strategy” to obtain a plea agreement.
Daley was fleeing with drugs in his car when he crashed into Johnson, who had attempted to put a set of spikes across the highway in Norwich to stop him.
