BISMARCK, N.D. (AP) - A Bismarck man convicted of firing a shotgun at a law enforcement officer in 2015 will be resentenced after winning his challenge with the North Dakota Supreme Court.

Branden Lyon was sentenced to life in prison last year with the possibility of parole. Lyon was convicted in October 2017 of attempted murder, two counts of terrorizing and illegal possession of a firearm related to a standoff with police in October 2015 in Bismarck.

The Bismarck Tribune says Lyon appealed that sentence, saying it was improper under the habitual offender statute. The Supreme Court agreed.

Judge Bruce Haskell cited Lyon’s lengthy and violent criminal history in handing down the life sentence. Lyon will be resentenced March 5 at the Burleigh County Courthouse in Bismarck.
