FARGO, N.D. (AP) - The City of Fargo is seeking dismissal of a discrimination lawsuit filed by a former North Dakota legislator who later worked as a Fargo firefighter.

Scot Kelsh claims he was a “protected person” under the Americans with Disabilities Act when he was terminated by the fire department in 2016. He’s seeking $1.8 million in damages.

KFGO reports Kelsh has also alleged that after he was diagnosed with work-related post-traumatic stress disorder, the city illegally disclosed confidential medical information. The city maintains that Kelsh voluntarily disclosed the information.

An attorney for the city, Howard Swanson, is asking a judge to dismiss the case and to award the city associated costs and attorney fees.
