DOVER, Del. (AP) - Delaware’s Supreme Court has upheld the dismissal of a lawsuit against state officials involving a prostitute’s abuse of her children.
Thursday’s court decision upholds a 2017 ruling in favor of Division of Family Services officials who had repeatedly investigated Tanasia Milligan and her children.
The investigations began in 2009, when Milligan’s son was born with marijuana in his system. In 2014, Milligan beat her 4-year-old daughter to death in a New Castle-area motel.
The boy’s aunt, as guardian, sued state officials for failing to protect the children.
The judge ruled that the guardian’s claims failed to overcome the protection from liability granted to state actors or employees who are sued for acts that require the exercise of their discretion and which are done in good faith and without gross negligence.
