DOVER, Del. (AP) - A Delaware judge has dismissed a lawsuit that pitted former partners in an Italian grocery store business in Rehoboth beach against one another.

The Chancery Court suit involved former partners in Touch of Italy Salumeria and Pasticceria.

In 2012, one partner, Louis Bascio, decided to withdraw from the business, allegedly saying he was moving to Pennsylvania and might open a business there.

But a few weeks later, Bascio, who allegedly said he would not compete with Touch of Italy, opened a competing Italian grocery, Frank and Louie’s Italian Store, on the same block as Touch of Italy.

His former partners sued, but a judge ruled this week that there was nothing in Touch of Italy’s LLC agreement that prevented any member from withdrawing and opening a competing business.
