BISMARCK, N.D. (AP) - The attorneys of a female Bismarck middle school teacher accused of having sex with a 15-year-old male student have filed a motion to dismiss the case.

The Bismarck Tribune reports (https://bit.ly/1fUuDRI ) the attorneys of 35-year-old Susan Duursma asked the judge to dismiss the case on the grounds of “selective prosecution and abuse of process.”

Duursma is accused of a sex act with the boy three times between March and July 2013. She has pleaded not guilty to three felony counts of corrupting or soliciting a minor.

The newspaper reports Duursma’s attorneys say the alleged victim and two witnesses made an unauthorized recording of an encounter with the former teacher and should have faced charges.

A prosecutor says a response to the motion by the defense is being prepared.
