ESPANOLA, N.M. (AP) - A New Mexico State Police officer who fatally shot a gunman in a shootout has been cleared.

KOAT-TV reports (https://goo.gl/mgJYns) First Judicial District Attorney Angela Pacheco announced Wednesday that a grand jury cleared officer Joey Gallegos this week for the shooting death of Rogelio (roh-HEH’-LEE’-oh) Cisneros Chavez.

According to authorities, Gallegos was shot in the stomach while serving a warrant at the Los Lomas apartments in Espanola in October 2013. Police say he then returned fire and killed Chavez.

Police say the 22-year-old Chavez was a suspect in a larceny investigation and had an active warrant for his arrest when Gallegos went to the apartment complex to look for him.

Gallegos has not returned to duty since the shooting because of injuries.
