LOUISVILLE, Ky. (AP) - An eastern Kentucky man who got a new trial on charges that he fatally shot a neighbor has been acquitted of murder.
Billy Reed Caudill of Jackson was convicted and sentenced in 2010 to 35 years in prison for the shooting death of neighbor Randall Carpenter. Police say the men had a long-standing property dispute and were shooting at each other when Carpenter was killed.
The Kentucky Supreme Court ruled in 2012 that Caudill should get a new trial because a prosecutor made improper comments while questioning him during the first one.
WYMT-TV (https://cjky.it/1mzZ8h0) reports a second trial ended Thursday with jurors in Wolfe County finding Caudill innocent of murder, but guilty on three counts of wanton endangerment.
Jurors recommended a 15-year sentence. Formal sentencing was set for June 5.
