MOBILE, Ala. (AP) - Votes for Chris McNeil won’t count in the Republican primary for House District 102 next week in Mobile County.

The Semmes businessman signed up with the Alabama Republican Party, but the party disqualified him after the primary ballot was printed. The party ruled his house is across the street from District 102 and is in District 101. McNeil took his case to Mobile County Circuit Court on Tuesday, but Judge Rick Stout said the court has no place in partisan primaries.

McNeil told Al.com (bit.ly/Sf9TtH) he doesn’t plan to appeal. Party officials said his name will still be on the ballot June 3, but the votes he gets won’t count.

Plant nursery businessman Jack Williams and constable Anthony Clarkbanks are running for the seat being vacated by Rep. Chad Fincher.
