BAYTOWN, Texas (AP) - Police say a Houston-area man has been charged in the fatal shooting of his estranged wife in front of police responding to reports of an intruder.

Baytown police said Monday that 39-year-old Elrey Gonzalez of Baytown had been charged with capital murder in the death of 41-year-old Elva Gonzalez.

Lt. Steve Dorris says police were summoned to the home Sunday afternoon. Dorris says officers arrived to witness a woman coming out of the home, followed by a gunman who shot her. An officer returned fire, grazing Elrey Gonzalez.

Investigators later learned that Elva Gonzalez’s children, ages 16 and 21, were at the home at the time. One of them had called 911.

Elrey Gonzalez was being held Monday in Baytown jail. Jail records didn’t list an attorney for him.
