MADRAS, Ore. (AP) - A 21-year-old Madras man has accepted a plea deal in the death of his wife’s 1-year-old daughter and is now out of jail.

The Bulletin reports that (https://bit.ly/2dHjZjh ) Garry Lee Vineyard II pleaded guilty Monday to one count of criminally negligent homicide and two counts of criminal mistreatment. He was released with credit for time served.

His attorney says charges of murder and first- and second-degree manslaughter and two additional counts of criminal mistreatment were dismissed.

Vineyard had been set to face trial in Jefferson County Circuit Court in the death of Katerina Austria.

Prosecutors alleged Vineyard and his wife, 26-year-old Raine Austria-Vineyard, withheld necessary food and care.

Vineyard’s attorney says the state could not determine the child’s cause of death.

District Attorney Steven Leriche didn’t return calls.
