BOSTON (AP) - Prosecutors say they’ve withdrawn charges against a former Massachusetts man charged with killing his neighbor in 1981 because DNA evidence was excluded.

The Norfolk district attorney’s office announced its decision Tuesday.

Keith Butler was indicted for the murder of Francis X. Hussey in Braintree. The 59-year-old, who now lives in Florida, was twice tried for murder. Both trials ended in hung juries.

He was indicted for a third time based on old blood evidence subjected to modern forensic techniques.

A judge ruled in April that the state couldn’t sufficiently establish that the blood was taken during Hussey’s autopsy and excluded it.

Butler lived two houses away from Hussey in 1981.

An attorney for Butler couldn’t immediately be reached.

Butler didn’t respond to a request for comment from The Patriot Ledger.
