CHICAGO (AP) - A Honduran immigrant who sued over “unlawful” detention at a county jail is in the custody of federal immigration authorities.

The Mexican American Legal Defense and Education Fund filed a federal lawsuit this week on Emil Santos‘ behalf. The lawsuit says the Fox Lake man posted bail April 1 for domestic violence charges, but remained detained in Lake County at Immigration and Customs Enforcement’s request.

MALDEF argues Santos wasn’t notified of an immigration case and the incarceration violated his constitutional rights.

It’s the latest lawsuit to challenge cooperation between local police and ICE.

Lake County disputes details, saying bail was posted Wednesday. A sheriff’s office spokesman says Santos was released to ICE Thursday and faces a deportation order for illegal re-entry into the country.

Santos has lived in the U.S. for 16 years. Attorneys say the lawsuit continues.
