CASA GRANDE, Ariz. (AP) - Developers of a motor sports park planned for Maricopa are appealing a judge’s ruling that allows a referendum challenging a permit for the project to go forward.
The Casa Grande Dispatch (https://goo.gl/yAnxiN ) reports that Private Motorsports Group’s lawyers contend in a brief filed Monday with the state Court of Appeals division in Tucson that a political action committee’s petition challenging the permit is invalid and the permit is not subject to referendum.
The Maricopa City Council approved the conditional use permit for the 280-acre (1131-hectare) racing project site in April.
PMG’s lawyers argued that the petition’s wording and margins didn’t meet state requirements and that a Pinal County Superior Court judge incorrectly ruled that the council’s permit decision was a legislative action rather than administrative.
