BIRMINGHAM, Ala. (AP) - Prosecutors say four men have been indicted on capital murder charges in the gunshot death of a 2-year-old boy in Birmingham.

Authorities say 18-year-old D’Marco Harris and a 20-year-old cousin, Mykahl Harris, are charged along with 21-year-old Joshua Carpenter and 18-year-old Tyrone Smith.

All four are charged in the killing of 2-year-old Ron’Narius Austin earlier this month. Police say he was shot while in a car with his mother and a man, who were injured.



A lawyer for Carpenter said Friday his client was in the wrong place at the wrong time, and an attorney for Smith didn’t immediately return a message.

Court records aren’t available to show whether either of the cousins has an attorney.

The shooting happened near an area that’s become a popular entertainment destination.
