SPRING CREEK, Nev. (AP) - A 38-year-old Spring Creek man has been found competent to stand trial for the alleged murder of his wife last summer.

Elko County District Court Judge Nancy Porter ruled Tuesday that Donald Fleming has the ability to understand the nature of the criminal charges against him and assist in his own defense.

The Elko Daily Free Press reports (https://tinyurl.com/lwa5tew ) that Fleming’s lawyer, Gary Woodbury, said he may ask for a private psychiatrist to re-evaluate him before a trial is scheduled.



Woodbury said earlier that Fleming was prescribed psychotropic medications and was previously diagnosed with depression, bi-polar disorder and anxiety.

Fleming is accused of fatally shooting his wife, Kristin, Fleming, at their home last June. He was bound over to district court in August on charges of both first- and second-degree murder with a deadly weapon.
