Judge Brett Kavanaugh is not the real issue. The liberals and “progressives” are really attacking the U.S. Constitution, the rule of law (including the presumption of innocence and due process) and civil society.

Article I of the Constitution vests all authority to make laws, at the national level, in Congress. Article VI, Clause 2 requires the U.S. Supreme Court and whatever lesser federal courts Congress may create to decide cases in accordance with the Constitution and U.S. law, and to leave lawmaking to Congress. Over the past half-century, though, the political left has misused the courts to make an end run around representative government, imposing by judicial decree measures that would never pass legislatures answerable to the voters. Abortion on demand, forced busing and same-sex “marriage” are a few examples. The left fears that a constitutionalist majority on the Supreme Court would halt its “fundamental transformation” of America, and then throw it into reverse.

The real question is, will we still be a self-governing people, or will we simply be dictated to by a black-robed oligarchy? The latter is the real goal that “progressives” are striving to make “progress” toward. Instead of taking us forward, they are actually taking us backward, to pre-Magna Carta, to the days when rights were not recognized — and we had only the privileges that those in power decided to magnanimously extend.
