DENVER (AP) - The operator of a light rail train that derailed in suburban Denver last January and injured nine passengers will not face charges.
Prosecutors say that there is not enough evidence to prove the operator acted recklessly and that state law excludes train operators from many driving offenses.
The train derailed on Jan. 28 and authorities determined it was traveling too fast as it approached curve. One woman was ejected from the train and her leg severed. Several other passengers were hospitalized.
The operator was fired, and Aurora police who investigated the incident had recommended nine assault charges against the operator.
