Video evidence of New England Patriots owner Robert Kraft and other men soliciting prostitutes inside a Florida day spa will be released to the public, prosecutors Wednesday in court filings.

“Absent a Court order, the State will be releasing the requested public records once it has retrieved and reviewed the records, and deleted any portions of the record which are statutorily exempt,” Palm Beach County State Attorney Dave Aronberg’s office said, according to WCVB.

Police and prosecutors said the video shows Mr. Kraft, who has pleaded not guilty to misdemeanor charges, paying for and receiving sexual favors at Orchids of Asia Day Spa in Jupiter, Florida in January.

Mr. Kraft’s legal team has filed several court motions to block the video’s release, saying it would prevent the Patriots’ owner from adequate privacy and from receiving a fair trial.

“Because the public release of the videos would infringe upon Mr. Kraft’s constitutionally protected privacy rights and would interfere with Mr. Kraft’s ability to obtain a fair trial, the Court has additional grounds for entering a protective order and preventing the disclosure of the videos,” they wrote, adding the videos would “add nothing appreciable to the public discourse.”

The prosecution said Florida law legally forces them to make the videos public and they cannot wait for a judge to rule on the decision.

“The State, as the custodian of the records, cannot delay the release of records to allow a person to raise a constitutional challenge to the release of the documents,” the prosecution wrote.
